Judge of the Commercial Court of Kharkiv region Alexander Mamaluy, who fought as a sniper in the ATO zone near Donetsk, defeated the Cabinet of Ministers in the Kyiv District Administrative Court, Glavnoe informs (RU).
Kyiv District Administrative Court ordered the Cabinet to develop a procedure for the provision of state support for children of ATO participants.
About this he wrote on his Facebook page.
“In my lawsuit inactivity of Cabinet of Ministers declared illegal by the court … the court obliged the Cabinet to fulfill requirements of law and develop a procedure for the provision of state support for children of ATO soldiers. Upon entry into force of the court decision – it should be executed immediately. IMMEDIATELY!” wrote Mamaluy.
He explained he went to court because the Cabinet has not yet developed a procedure for the provision of state support for children of combatants, although it had to do it last July.
Because of this, the benefits provided by the law “On the status of war veterans, guarantees of their social protection”, as a rule, exist only on paper.
Therefore, Mamaluy required recognizing inactivity of the Cabinet illegal, oblige them to accept the order and conditions for granting state support for children of combatants in the form of tuition fees at the expense of the state budget. Kyiv District Administrative Court satisfied the requirements of judge-sniper.
