The Supreme Economic Court of Ukraine fully satisfied the requirements of the prosecutor of the Pervomaysk (Kharkiv region) prosecutor’s office and declared privatization of the elevator with a total area of 30 thousand square meters to be illegal.
“At the end of 2011, the executive committee of the local council authorized a state enterprise, which was reorganized into a public joint stock company, to issue a certificate of the right of private ownership of non-residential facilities and facilities of the local grain elevator,” said the head of the local prosecutor’s office, Vladimir Govorukha.
Over time, on the basis of this document the grain enterprise valued at 21.3 million UAH became the property of the private structure. However, according to law enforcement officers, this fact have not been confirmed documentary. Thus, in accordance with the legislation, the enterprise could not be privatized.
In addition, the Chuguev local prosecutor’s office appealed in court an illegal lease of nearly 45 hectares of farmland.
“The lessee paid the amount several times less than it was necessary”, said the head of the local prosecutor’s office Dmitry Kolodinskiy.
